A TOOWOOMBA man accused of spitting in a policeman's face after having assaulted two men at a Mort Street residence was yesterday remanded in custody.
Maurice Lacroix Replica Watches Andrew Bill Diggles, 31, is accused of striking one of the complainant men with an aluminium bed pole and further assaulting both men during a disturbance at the residence on Monday afternoon.
After police arrived at the scene, Diggles was taken to hospital for assessment where he allegedly became aggressive again, creating a disturbance leading to his spitting in a policeman's face.
Dressed in khaki pants and green singlet, a handcuffed Diggles appeared briefly before Toowoomba Magistrates Court yesterday on two counts of assault occasioning bodily harm and one of assault occasioning bodily harm while armed arising from the Mort Street altercation and serious assault (spitting) of a police officer, public nuisance, common assault and obstructing police relating to the hospital incident.
He was not required to enter any pleas to the charges and Hublot Replica Watches duty solicitor Brock Harm told the court his client would not be applying for bail at this stage.
Marni Handbags Prosecutor Senior Constable Karen Dearling said police sought a disease test order due to the defendant having allegedly spat on the policeman.
After some consultation with his client, Mr Harm told the court Diggles would consent to the order and Magistrate Bruce Schemioneck formally ordered that the defendant provide a sample in line with a disease test order while at the watch house.
There being no application for bail, Mr Schemioneck remanded Diggles in custody and adjourned all matters for mention back in the same court on March 18.
